Terms of Service
Basic terms for using or evaluating MakeYourMCP during early access.
TL;DR (Plain-English Summary): These terms state that MakeYourMCP is currently in early access, meaning features may change as we optimize the platform. You are responsible for the policies you set and the data sources you connect. Please do not use the system to bypass access controls or violate security standards.
Last updated: June 30, 2026.
1. Use of the service
MakeYourMCP is provided for early access evaluation unless a separate written agreement says otherwise. You are responsible for configuring connectors, permissions, and environments according to your organization's security requirements. Access to the platform is granted on a per-organization basis during the early access period and may not be transferred or sublicensed.
2. Acceptable use
You may not use the service to:
- Violate applicable laws or regulations in any jurisdiction.
- Bypass, circumvent, or disable access controls on systems you do not own or have authorization to access.
- Attack, probe, or perform security testing on systems belonging to third parties without their explicit written consent.
- Process regulated data (e.g. PHI under HIPAA, cardholder data under PCI-DSS) in an early access environment without a separate written Data Processing Agreement.
- Reverse engineer, decompile, or attempt to extract the source code of the MakeYourMCP gateway or its underlying infrastructure.
- Resell, white-label, or offer access to the service to third parties without prior written approval.
3. Data responsibility
You are the data controller for any data processed through connectors you configure. MakeYourMCP acts as a data processor on your behalf, applying the access policies and governance rules you define. You are responsible for ensuring that your use of the service complies with applicable data protection laws, including GDPR, CCPA, and HIPAA where relevant.
You should not place production secrets, regulated data, or personally identifiable information (PII) into the early access environment without a signed Data Processing Agreement (DPA). Please contact us at connect@makeyourmcp.com to arrange a DPA before connecting production data sources.
4. Intellectual property
MakeYourMCP and its underlying technology, brand assets, documentation, and gateway infrastructure remain the exclusive intellectual property of the company. Nothing in these terms grants you a license to the source code, infrastructure designs, or proprietary algorithms used to power the service.
Policy files, connector configurations, and access rules you create within the platform remain your property. We do not claim ownership of the governance policies you author.
5. Limitation of liability
The service is provided “as is” during the early access period. To the fullest extent permitted by applicable law, MakeYourMCP is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to data loss, security incidents, or interruption of access, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these terms or your use of the service shall not exceed the amounts paid by you to MakeYourMCP in the 12 months preceding the claim (or, if no fees have been paid, USD $100).
6. Availability
Early access features may change, pause, or be limited while we improve reliability, security controls, and product fit. We will provide reasonable notice of significant changes where possible, but make no guarantees of uptime or feature availability during the early access period.
7. Governing law
These terms are governed by the laws of the jurisdiction in which MakeYourMCP is incorporated, without regard to conflict of law provisions. Any disputes arising from these terms shall be resolved through binding arbitration or the courts of that jurisdiction, as determined by us in good faith.
8. Changes to these terms
We may update these Terms of Service from time to time. When we do, we will revise the “Last updated” date at the top of this page and, for material changes, notify early access users by email. Continued use of the service after changes are posted constitutes acceptance of the revised terms.
9. Security certifications
SOC 2 Type II certification is on our roadmap and has not yet been completed — we are not currently SOC 2 certified. We actively design and maintain our systems to align with SOC 2 and similar frameworks in the meantime; see the Security & Trust Center for our current controls. We will update this page once an audit is complete and a report is available.
